How to File a Complaint
Anyone may file a complaint against the license of a Registered Professional Nurse or a Licensed Practical Nurse. Section 383.133.1 RSMo mandates that the chief executive officer or similarly empowered official of any hospital, ambulatory surgical center, temporary staffing agency, nursing home , any nursing facility, or any entity that employs or contracts with licensed health care professionals to provide health care services to individuals report to the appropriate health care professional licensing authority any disciplinary action against any health care professional or the voluntary resignation of any health care professional whom any complaints or reports have been made which might have led to disciplinary action. Section 383.133.4 RSMo, provides that there shall be no liability or cause of action against any entity required to file a report/complaint with the licensing agency if made in good faith and without malice. Please refer to the Public Complaint Handling and Disposition Procedure, 20 CSR 2200-4.030.
To determine if the incident in question should be reported to the Board office, please refer to the attached document based on Section 335.066, RSMo, Grounds for Denial or Discipline. The Missouri State Board of Nursing reviews all complaints, WHICH MUST BE IN WRITING.
According to the State of Missouri Nursing Practice Act (335.066, RSMo), anyone who makes a complaint and does so in good faith SHALL NOT be subject to civil damages because of the allegation made.
